Please read these Terms of Service ("Terms") carefully before using the WazapGH API platform ("Service") operated by WazapGH ("we", "us", or "our").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Description of Service

WazapGH provides an API platform that enables users to send WhatsApp messages programmatically. Our Service includes:

  • REST API for sending and receiving WhatsApp messages
  • Dashboard for managing WhatsApp instances and API keys
  • Message tracking and delivery status updates
  • Webhook notifications for message events

3. Account Registration

To use our Service, you must:

  • Create an account with accurate and complete information
  • Be at least 18 years old
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

4. Acceptable Use

You agree NOT to use our Service to:

  • Send spam, unsolicited messages, or bulk promotional content
  • Harass, threaten, or intimidate any person
  • Distribute malware, phishing attempts, or fraudulent content
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Impersonate any person or entity
  • Collect personal data without proper consent
  • Interfere with or disrupt the Service

5. WhatsApp Compliance

You acknowledge that:

  • WhatsApp has its own Terms of Service that you must comply with
  • We are not affiliated with WhatsApp or Meta
  • WhatsApp may terminate your access for violations of their policies
  • You are responsible for obtaining consent from message recipients

6. Subscription and Payments

Our paid plans are billed monthly. By subscribing, you agree that:

  • Subscription fees are charged at the beginning of each billing period
  • Fees are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • You are responsible for all taxes associated with your subscription

7. Message Limits and Fair Use

Each plan includes a specific number of messages per month:

  • Unused messages do not roll over to the next month
  • Exceeding your plan limits may result in service restrictions
  • We reserve the right to enforce rate limits to ensure fair use

8. API Usage

When using our API, you agree to:

  • Keep your API keys confidential
  • Not share API keys or allow unauthorized access
  • Comply with rate limits for your plan
  • Not attempt to reverse engineer or exploit the API

9. Intellectual Property

The Service and its original content, features, and functionality are owned by WazapGH and are protected by international copyright, trademark, and other intellectual property laws.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. MESSAGE DELIVERY IS DEPENDENT ON WHATSAPP AND THIRD-PARTY SERVICES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAZAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

12. Indemnification

You agree to indemnify and hold harmless WazapGH from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we determine:

  • Violates these Terms
  • Is harmful to other users or third parties
  • Is fraudulent or illegal

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.
